What is Probate?

Probate is a court-supervised proceeding where an estate is administered. The Executor or Administrator is given authority by the Court to pay debts, claims, and taxes. The remaining assets are liquidated and distributed among the beneficiaries.

How long will Probate take?

An estate that does not have many assets and has no outstanding debts, can usually be settled within six months. This period can be lengthened if an estate tax return is required or if there are outstanding debts that must be paid to creditors. Keep in mind, creditors may make claims on the estate for six months. If there are complex assets, such as a business or properties located in several states, probate can last for longer than a year.

How Does Probate Work in Cincinnati, Ohio?

Probate is a legal process that takes place after an individual, known as the "decedent," passes away. In Ohio, the probate court collaborates with an individual appointed in the decedent's will, referred to as the "executor" or "personal representative," to facilitate the distribution of the decedent's estate. If the decedent did not designate an executor in their will, the court will appoint one, often choosing an heir.

Throughout the probate proceedings, the probate court and the appointed executor work in tandem to ensure the proper distribution of the decedent's estate. This involves various tasks, such as:

  1. Notifying individuals named in the decedent's will about the passing and the impending probate process.
  2. Providing the court with a thorough inventory of the decedent's estate, including assets and their respective values.
  3. Addressing any concerns raised by individuals regarding the validity of the will or the probate process.
  4. Settling any outstanding debts the decedent owed to creditors before their passing.
  5. Distributing the decedent's assets and estate among beneficiaries in accordance with the terms outlined in the will, once all preceding steps are completed.

The probate process can be intricate, time-consuming, and, at times, costly. It can pose challenges, especially for those unexpectedly thrust into the complexities of estate planning.

To navigate through these challenges effectively, engaging the services of a Cincinnati estate planning attorney is highly advisable. At Keller, Barrett & Higgins, our team comprehensively understands the probate and estate planning procedures in Ohio. Let us shoulder the responsibilities of your case, allowing you to focus on your well-being during this process.
